Vor dem Hintergrund der Konzeption des Ausnahmezustands bei Schmitt und Agamben sollen im Folgenden die Unterschiede zwischen den theoretischen Ansätzen erarbeitet werden. Dabei wird zunächst auf Schmitts Terminus des Ausnahmezustands eingegangen und die Funktionen des Begriffs in seinem Souveränitätskonzept dargelegt. Darauf aufbauend erfolgt die Auseinandersetzung mit Agambens Begriff des Ausnahmezustands. Anschließend werden die beiden theoretischen Ansätze einander gegenübergestellt.

„Souverän ist, wer über den Ausnahmezustand entscheidet“. Diese Definition des Ausnahmezustands trifft der Staatsrechtler Carl Schmitt in seiner Schrift „Politische Theologie“. Schmitt verweist mit seiner prägnanten Definition darauf, dass der Ausnahmezustand kein Tatbestand ist, den die Rechtsordnung bestimmt, sondern dass er nur in Abhängigkeit von der Entscheidung des Souveräns über ihn existiert, gerade weil er eine Ausnahme vom Normalzustand darstellt, die nicht in Gesetzen geregelt werden kann.

Der Rechtsphilosoph Giorgio Agamben rekurriert auf Schmitts Konzeption des Ausnahmezustands in seinem Werk „Homo sacer. Die souveräne Macht und das nackte Leben“. Er erweitert die Definition um eine biopolitische Perspektive: „In der modernen Biopolitik ist derjenige souverän, der über den Wert oder Unwert des Lebens als solches entscheidet“. Agambens Verständnis von Biopolitik steht in der culture Foucaults, wobei er den Anspruch erhebt, dessen Konzept eine neue Deutung zu verleihen: Die Biopolitik als historische Konstante der gesellschaftlichen Ordnung und in der Moderne in ihrer reinsten shape verwirklicht im Konzentrationslager des 20. Jahrhunderts. Agamben bezieht sich in seiner Rekonstruktion neben Foucault und Schmitt auf varied weitere Philosophen wie Walter Benjamin.

Die Grundlage der vorliegenden Arbeit bilden Agambens Werk „Homo sacer. Die souveräne Macht und das nackte Leben“, das 1995 erschienen ist, und die Schrift „Politische Theologie“, die Schmitt 1922 veröffentlichte.
